However, it seems some parts of the argument should already be settled as it is thought a prenuptial agreement was signed when they got married that protects the money Tom made before he met Katie. Divorce papers were filed this week by Katie, who cited 'irreconcilable differences'. 'Katie's primary concern remains, as it always has been, her ­daughter's best interest.' Nevertheless, it seems things are gearing up for a bitter battle over their daughter, with Cruise - in his own, brief, statement - adding he is 'concentrating on his... children'. Katie, 33, is also said to be demanding a slice of the properties she owns together with Cruise. For months there has been speculation the couple were not getting along, but they repeatedly denied these rumours. But the Batman Begins actress confirmed the speculation this week by announcing the break-up. A spokesman for the actor added: 'Katie has filed for divorce and Tom is deeply saddened and is concentrating on his three children.'
