The Church of Scientology has denied using vehicles to tail Katie Holmes following the news she is divorcing husband Tom Cruise.
Katie announced she was filing for divorce on Friday, with a representative for Tom saying he was 'deeply saddened' by the split.
As rumours of what caused the split circulate, attention has turned to a number of vehicles that have repeatedly been seen outside Katie's apartment in New York, where Holmes has been staying with daughter Suri since news of the divorce broke.
Photographers have reported seeing a white Cadillac Escalade and black Mercedes SUV in the area constantly and warned Katie's driver and bodyguard that she was being followed, with some sources suggesting Holmes was concerned she may be under surveillance by Scientologists.
However the Church's lawyer has strenuously denied the claims, with Gary Soter telling celebrity website TMZ that the Church of Scientology is not following Katie or conducting surveillance on her.
The news comes as Cruise hit back at his estranged wife by filing for divorce in Los Angeles, days after Holmes filed for divorce in New York.
The stage is now set for a bitter custody battle, with Katie hoping divorce proceedings will be held in New York where she has a better chance of gaining full custody of the couple's six-year-old daughter.
It is rumoured Katie is hoping to gain full custody of Suri to ensure she is not raised as a Scientologist, but it seems Tom will be requesting joint custody. A source told RadarOnline: 'Team Cruise is going to assert that Katie
doesn't meet the residency requirements to file in New York, and that both live full time in California, specifically Los Angeles.
'Tom will file for divorce in California, and will request joint custody. There is absolutely no way that he is going let Katie have sole custody. This is going shape up to be a very contentious custody battle.'
Katie's lawyer confirmed news of the couple's split last week, telling People magazine: 'This is a personal and private matter for Katie and her family,' he told People magazine.
'Katie's primary concern remains, as it always has been, her daughter's best interest.'
A representative for Tom suggested the decision to split wasn't mutual, saying later: 'Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children.
'Please allow them their privacy.'
Katie and Tom started dating in early 2005, becoming engaged in June that year.
Holmes gave birth to daughter Suri in April 2006, with the couple marrying in a lavish ceremony in Italy six months later.
