Man accused of assaulting Lindsay Lohan in hotel released without charge

A man accused of assaulting Lindsay Lohan in a New York hotel room during an argument over mobile phone images has been released.

Christian LaBella, 25, was initially charged with two counts of assault and two counts of harassment, but the NYPD have now dropped the charges, after detectives revealed there was not enough evidence to support Lindsay's claims.

And it has also emerged that LaBella and the Mean Girls star were both filing harassment complaints against each other after they were interviewed by police about their run-in.

While LaBella could not be reached for comment, Lohan's publicist Steve Honig has expressed his anger that police did not charge LaBella.

'We think it's both distressing and outrageous,' he said. 'Lindsay was assaulted and there needs to be a consequence for that.'

Lohan is believed to have invited him back to her suite at New York's W Hotel after partying at the 1 Oak nightclub with friends.

However, after bringing back a group to her room she soon noticed that the man had taken pictures of her on his phone.

According to US reports she challenged LaBella, who then became angry and attacked her, choking Lindsay and throwing her to the ground before one of her friends pulled him away.

LiLo then activated the fire alarm and police were called to the building and later arrested the 25-year-old man.

Following the alleged late-night scuffle the Mean Girls actress only sustained minor scratches to her hands and refused any medical help at the scene.

A spokesperson for the star said: 'Lindsay was assaulted early this morning in a New York hotel. While she did sustain some injuries, she was not hospitalised.

'The assailant was arrested and is currently in police custody. Lindsay has spoken with police and is fully cooperating with the investigation.'
