The famous paparazzo, whose real name is Jamie Fawcett, was accused of threatening the 37-year-old's life as he tried to get a photo of her and husband Stephen Belafonte in their yacht on Sydney Harbour last week.

Mel applied for an Apprehended Violence Order against Mr Fawcett, which was granted by magistrate Jacqueline Milledge.

The famed snapper is now prohibited from 'loitering' within 50metres of the couple, as well as coming within 5metres of them.

Mr Fawcett didn't appear at the Waverley Court yesterday morning but his lawyer, Roland Day, told the Australian Associated Press that his client has agreed to the terms on the provision 'that he is still able to be a photographer and do his job.'

British-born Mel, who was a guest judge on this year's series of The X Factor UK, currently lives in Sydney with her family where she is judging the Australian version of the show.

She was smartly dressed for her court appearance, wearing a slim-fitting blue dress, minimal make-up and her hair in loose waves.

The incident is said to have occurred while Brown and Belafonte were relaxing on their 13.5m launch, Time Out, when Fawcett was spotted hiding behind a rock.

As the couple moved to different beaches, it is claimed Fawcett followed them until they decided to moore their boat at Vaucluse, Eastern Suburbs where they live.

As Mel left the yacht on a kayak with her assistant, it is alleged the snapper nearly knocked them off into the water as he circled their boat.

A war of words is then thought to have erupted between Mel's husband and Mr Fawcett, with Belafonte apparently being told: 'You don't know who you are f***ing with, I will kill you.'

The order will remain in place until November 22 when the case returns to court.
